SENATE BILL 1391 By: Rogers
AS INTRODUCED
An Act relating to the Oklahoma Water Resources
Board; creating the Arkansas River Levee Improvement
Revolving Fund; making an appropriation; stating
source of funds; allowing certain deposits ; stating
purpose; providing for codification; providing an
effective date; and declaring an emergency.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Se ction 1085.7D of Title 82, unless
there is created a duplication in numbering, reads as follows:
A. There is hereby create d in the State Treasury a revolving
fund for the Oklahoma Water Resources Board to be designated the
“Arkansas River Levee Improvement Revolving Fund”. The fund shall
be a continuing fund, not subject to fiscal year limitations, and
shall consist of all monie s received by the Oklahoma Water Resources
Board from legislative appropriations provided for the purpose of
providing levee improvements and matching funds for levee projects
along the Arkansas Riv er. All monies accruing to the credit of the
fund are hereby appropriated and may be budgeted and expended by the

Oklahoma Water Resources Board for the purpose provided for in this
section. Expenditures from the fund shall be made upon warrants
issued by the State Treasurer against claims filed as prescribed b y
law with the Director of the Office of Managemen t and Enterprise
Services for approval and payment.
B. Notwithstanding any oth er provision of law, income and
earnings on the fund shall accrue to th e fund and may be used for
the purposes provided for in this section .
SECTION 2. There is hereby appropriated to the Oklahoma Water
Resources Board for deposit to the Arkansas River Levee Improvement
Revolving Fund from any monies not otherwise appropriated from the
General Revenue Fund of the State Treasury for the fiscal year
ending June 30, 2025, the sum of Sixty-seven Million Dollars
($67,000,000.00) or so much thereof as may be necessary to fund the
Arkansas River Levee Improvement Revolving Fund.
SECTION 3. This act shall become effective July 1, 2024.
SECTION 4. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof thi s act shall take effect and
be in full force from and after its passage and approval.
