BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be co dified in the Oklahoma Statutes as Section 6060.19 of Title 36, unless there is created a duplication in numbering, reads as follows: A. As used in this section: 1. “Chronic condition” means a serious health condition which: a. requires periodic visits no less than twice per calendar year for treatment by a health care provider , b. continues over an extended period of time, or c. may cause episodic, rather than a continuing period of, incapacity; and Req. B. Any high deductible health plan that is offered, issued, or renewed on or after the effective date of this act shall not subject prescription drugs used to treat c hronic conditions to the annual deductible established by the plan. C. The Insurance Commissioner, in consultation with the Oklahoma Health Care Authority, shall promulgate rules to es tablish a list of qualifying prescription drugs unde r subsection B of this section and any other rules necessary to e ffectuate the provisions of this section.
