AS INTRODUCED 
 
An Act relating to high deductible health plans; 
defining terms; providing for certain prescription 
drugs to be covered outside of certai n deductible 
requirements; directing rule promulgation; providing 
for codification; and providing an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be co dified 
in the Oklahoma Statutes as Section 6060.19 of Title 36, unless 
there is created a duplication in numbering, reads as follows: 
A. As used in this section: 
1.  “Chronic condition” means a serious health condition which: 
a. requires periodic visits no less than twice per 
calendar year for treatment by a health care provider , 
b. continues over an extended period of time, or 
c. may cause episodic, rather than a continuing period 
of, incapacity; and

2.  “High deductible health plan ” means a high deductible health 
plan as defined pursuant to Section 7002 of Title 36 of the Okla homa 
Statutes. 
B.  Any high deductible health plan that is offered, issued, or 
renewed on or after the effective date of this act shall not subject 
prescription drugs used to treat c hronic conditions to the annual 
deductible established by the plan. 
C.  The Insurance Commissioner, in consultation with the 
Oklahoma Health Care Authority, shall promulgate rules to es tablish 
a list of qualifying prescription drugs unde r subsection B of this 
section and any other rules necessary to e ffectuate the provisions 
of this section. 
SECTION 2.  This act shall become effective January 1, 2025.
