SENATE BILL 1754 By: Garvin
AS INTRODUCED
An Act relating to the Office of Juvenile Affairs;
amending 62 O.S. 2021, Section s 155, as amended by
Section 34, Chapter 29, O.S.L. 202 3, and 203 (62 O.S.
Supp. 2023, Section 155) , which relate to public
finance; removing language r elating to the Santa
Clause Commission; repealing 10 O.S. 2021, Sections
361, 362, and 363, which relate to th e Santa Clause
Commission; and providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 62 O.S. 2021, Section 155, as
amended by Section 34, Chapter 29, O.S.L. 2023 (62 O.S. Supp. 2023,
Section 155), is amended to read as follows:
Section 155. A. There is hereby created in the State Treasury
a revolving fund for each of the following state boards,
commissions, and departments:
1. The Board of Governors of the Lic ensed Architects, Lan dscape
Architects and Registered Commercial Interior Designers of Oklahoma;
2. Oklahoma Funeral Board;
3. Board of Podiatric Medical Examiners;
4. Board of Chiropractic Examiners;

5. State Board of Medical Licensure and Supervision;
6. Oklahoma Board of Nursing;
7. State Board of Osteopathic Examiners;
8. State Board of Pharmacy;
9. State Board of Licens ed Social Workers;
10. Oklahoma New Motor Vehicle Commission; and
11. Oklahoma Real Estate Commission; and
12. Santa Claus Commission.
B. Each revolving fund shall consist of all monies received by
the boards, commissions, and departments, pursua nt to statutory
authority, but not including appropriated funds. These revolving
funds shall be continuing funds, not subject to fiscal year
limitations, and shall be under the control and management of the
administrative authorities of the respective boar ds, commissions, or
departments.
C. Expenditures from the revolving funds shall be made purs uant
to the laws of the state and the statutes relating to the boards,
commissions, and departments, and without legislative appropriation.
Warrants for expenditures from the revolving funds shall be drawn by
the State Treasurer, based on claims signed by an authorized
employee or employees of the respective boards, commissions, or
departments and approved for payment by the Director of the Office
of Management and Enterprise Services.

SECTION 2. AMENDATORY 62 O.S. 2021, Section 203, is
amended to read as follows:
Section 203. A. Except as otherwise provided by subsectio n B
of this section, all monies that may come into the State Treasury,
pursuant to the provisions of Section 201 et seq. of this title,
together with all amounts that may be received by the State
Treasurer as investment in come or as interest on average dai ly bank
balances, including investment income or interest on deposits from
funds deposited to the credit of the Constitutional Reserve Fun d
created pursuant to Section 23 of Article X of the Oklaho ma
Constitution, shall be apportioned and credited to the G eneral
Revenue Fund for the current year.
B. The provisions of subsection A of this section shall not
apply to:
1. Interest received on deposits from funds under the control
of the Commissioners of the Land Office;
2. Funds in the Department of Human Se rvices Federal
Disallowance Fund;
3. Interest received on deposits from funds under the control
of the Santa Claus Commission;
4. The Risk Management Revolving Fund;
5. 4. Investment income and interest received from funds in the
Quartz Mountain Revolvi ng Fund from insurance claims;

6. 5. The Drinking Water Treatment Revolving Lo an Account and
the Drinking Water Treatment Loan Administrative Fund;
7. 6. The Clean Water State Revolving Fund Loan Account and the
Clean Water State Revolving Fund Loan Admi nistrative Fund;
8. 7. The State Infrastructure Bank Revolving Fund;
9. 8. The Nursing Facility Quality of Care Fund;
10. 9. The Oklahoma Tourism and Rec reation Department Revolving
Fund effective July 1, 2003;
11. 10. The Golf Course Operations Revolv ing Fund effective
July 1, 2003; and
12. 11. Interest received on investments from funds in the
County Bridge and Road Improvement Fund, the Emergency and
Transportation Revolving Fund, the County Road Machinery and
Equipment Revolving Fund, the High Prio rity State Bridge Revolving
Fund as created in Section 506 of Title 69 of the Oklahoma Statutes,
and the County Improvements for Roads and Bridges Fund as created in
Section 507 of Title 69 of the Oklahoma Statutes .
SECTION 3. REPEALER 10 O.S. 2021, Sections 361, 362, and
363, are hereby repealed.
SECTION 4. This act shall become effective November 1, 2024.
