An Act relating to the Oklahoma Tax Commission; 
amending 68 O.S. 2021, Section 105.1, which relates 
to designation of peace officer; modifying authority 
to designate peace officer; prescribing duties; 
requiring certain certification; eliminating certain 
prohibition; prohibiting certain investigations; and 
providing an effective date . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     68 O.S. 2021, Section 105.1, is 
amended to read as follows: 
Section 105.1.  The Oklahoma Tax Commission shall have the 
authority to designate as a peace officer the one (1) employee in 
the position of Director of Internal Affairs for the purpose of 
Safety and Security whose duties include conducting personnel 
investigations, and background checks, and assisting with security 
of Oklahoma Tax Commission facilities.  An employee designated as a 
peace officer pursuant to this section sha ll be certified pursuant

to Section 3311 of Title 70 of the Oklahoma Statutes and have the 
authority to review information contained in the files of fe deral, 
state, or local law enforcement officials in order to conduct the 
investigations prescribed by thi s section.  The employee designated 
as a peace officer shall not be authorized to carry a firearm nor 
shall be required to be certified pursuant to Sec tion 3311 of Title 
70 of the Oklahoma Statutes conduct any type of investigations 
related to violations o f the tax laws of this state which would also 
include criminal investigations . 
SECTION 2.  This act shall become effective November 1, 2024.
