An Act relating to Commissioners of the Land Of fice; 
amending 64 O.S. 2021, Section 1002 , which relates to 
powers and authority of the Commissioners; allowing 
the Commissioners to lease cer tain property to 
certain schools; providing an effective date; and 
declaring an emergency . 
 
 
 
 
AUTHOR:  Remove Representative Echols as principal House author and 
substitute with Representative McBride 
 
 
AMENDMENT NO. 1.  Strike the title, enacting clause, and entire bill 
and insert: 
 
 
"An Act relating to Commissioners of the Land Office ; 
amending 64 O.S. 2021, Section 1093, which relates to 
rulemaking; directing Commissioners to hold hearing 
and provide notice to lessees prior to taking certain 
action; requiring certain notice for Commissioners' 
interpretation to be binding; providin g for public 
inspection of interpretation; providing an effective 
date; and declaring an emergency . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     64 O.S. 2021, Section 1093, is 
amended to read as follows:

Section 1093.  A. The Commissioners of the Land Offic e are 
hereby authorized to make and promulgate appropriate rules and 
regulations for the purpose of carrying into effect the provisions 
of this act. 
B.  Prior to the adoption, amendment, or revocation of any ru le 
or regulation, the Commissioners of the Lan d Office shall: 
1.  Schedule and hold a hearing on the proposed adoption, 
amendment, or revocation of the rule or regulation at which persons 
may present oral argument, data, op inions, and views on the proposed 
action; and 
2.  Not less than thirty (30) days prior to the scheduled 
hearing, mail a copy of the notice , required by the Administrative 
Procedures Act to be published in “The Oklahoma Register” , directly 
to all persons currently leasing land or minerals from the 
Commissioners of the Land Office at t he time the adoption, 
amendment, or revocation of the rule or regulation is proposed.  The 
notices shall be maile d via United States mail to the last-known 
address of each current lessee shown in the records of the 
Commissioners of the Land Office. 
The requirements provided in this subsection shall be in 
addition to the requirements of the Administrative Procedures A ct. 
C.  No interpretation by the Commissioners of the Land Offic e of 
its rules and regulations sh all be binding on any persons affected 
by the interpretation, or given deference by any court, unless the

interpretation is first published in “The Oklahoma Re gister” and 
direct notice of publication is mailed via United St ates mail to the 
last-known address of all persons currently leasing land or mi nerals 
from the Commissioners of the Land Office at the time the 
interpretation is adopted .  The Commissioners of the Land Office 
shall also make any such interpretations available for public 
inspection in its office and on its website. 
SECTION 2.  This act shall become effective July 1, 2024. 
SECTION 3.  It being immediate ly necessary for the preservation 
of the public peace, health, or safety, an emergency is hereby 
declared to exist, by reason whereof thi s act shall take effect and 
be in full force from and after its passage and approval. "

An Act relating to Commissioners of the Land Of fice;

the Commissioners to lease certain property to 
certain schools; providi ng an effective date; and 
declaring an emergency . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA : 
SECTION 1.     AMENDATORY     64 O.S. 2 021, Section 1002, is 
amended to read as follows: 
Section 1002. In order that the state sc hool lands may be 
administered in a manner to assure their preservat ion as well as the 
appreciation of the trust estate and the maximum return fr om the use 
of state school lands for the support and maintenance of the common 
schools of the state, the Commis sioners of the Land Office, as 
trustees of the state school lands, a re hereby authorized and 
empowered to: 
1.  Categorize the state school lands as agricultural or 
commercial according to the use which the Commissioners of the Land

Office determine from ti me to time to be most beneficial to the 
interest of the present and future beneficiaries of the state; 
2.  Sell, at public auction after appraise ment, the surface 
interest in any state school land categorized by the Commissioners 
of the Land Office to be e xcess or when determined to be in the best 
interest of the trust; 
3. Institute projects to develop and im prove those state school 
lands which are categorized as commercial lands; 
4. Acquire by exchange, purchase, gift , or grant all real 
property and to acquire by exchange, purchase, gift , or grant all 
personal property necessary for the purpose of utilizing trust lands 
for the development of comm ercial and agricultural leases to 
maximize trust income for present and future beneficiaries; and 
5.  Exchange any real property of the trust for other real 
property of equal or g reater value to maximize income for pr esent 
and future beneficiaries, in acco rdance with and under the safeguard 
of trust requirements ; and 
6.  Lease real property to a charter school form ed pursuant to 
the Oklahoma Charter Schools Act.  The Commissioners of the Land 
Office shall provide a right of first refusal to a charter school 
located in the same county or an adjacent county as the real 
property available for lease . 
SECTION 2.  This act shall become effective July 1, 2023.
