SENATE BILL 569 By: Montgomery
AS INTRODUCED
An Act relating to the state Medicaid program;
directing Oklahoma Health Care Authority to submit
certain State Plan amendment; requiring inclusion of
certain services; authorizing promulgation of rules;
providing for codification; and providing an
effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
SECTION 1. NEW LAW A new section o f law to be codified
in the Oklahoma Statutes as Section 5028.2 of Title 63, unless there
is created a duplication in numbering, reads as follows:
A. The Oklahoma Health Care Authority shall sub mit a Medicaid
State Plan amendment to the Centers for Medica re and Medicaid
Services to permit schools to seek reimbursement for Medicaid
1905(a) services delivered in a school setting without the
requirement for an individualized education plan (IEP).
B. Services included in the State Plan amendment shall include :
1. Nursing;
2. Behavioral health;
3. Speech therapy;

4. Occupational therapy; and
5. Physical therapy.
C. The Oklahoma Health Care Authority Board may promulgate
rules as necessary to prov ide for the implementation of this
section.
SECTION 2. This act shall become effective November 1, 2023.
