SENATE BILL 570 By: Newhouse
AS INTRODUCED
An Act relating to property; authorizing request for
removal of discriminatory provi sion from certain
instrument; stating proper court for filing of
certain motion; providing for codification; and
providing an effective date .
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A ne w section of law to be codified
in the Oklahoma Statutes as Section 323 of Title 60, unless there is
created a duplication in numb ering, reads as follows:
A person who owns real property or an interest in real property
for which the title includes a recorded conveyance instrument
containing a discriminator y provision pursuant to the Fair Hous ing
Act, 42 U.S.C. Section 3601 et seq., or another person with the
permission of the owner, may request the removal of the
discriminatory provision from the instrument . A motion for removal
of the discriminatory provision shall be filed with the clerk of the
district court in the county in wh ich the real property records are

recorded or of another court having jurisdiction over real property
matters in the county .
SECTION 2. This act shall become effec tive November 1, 2023.
