AS INTRODUCED
An Act relating to marriage; prohibiting the
recognition of common-law marriage in this state;
providing exception; construing provisio n; providing
for codification; and providing an effective date .
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be cod ified
in the Oklahoma Statutes as Section 3.2 of Titl e 43, unless there is
created a duplication in numbering, reads as follows:
On or after the effective date of this act , a common-law
marriage in this state shall not be recognized as a valid form of
marriage in this state; provided, however, any commo n-law marriage
recognized as valid b y a court of competent jurisdiction prior to
the effective date of this act shall continue to be recognized as
valid in this state.
SECTION 2. This act shall become effective November 1, 2023.
