AS INTRODUCED 
 
An Act relating to professions and occupations; 
amending 59 O.S. 2021, Section s 536.8 and 3040.13, 
which relate to registration; remo ving requirement 
for license registration to a county clerk; repealing 
59 O.S. 2021, Section 510, which relates to 
registration of corporations; and providing an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     59 O.S. 2021, Section 536.8, is 
amended to read as follows: 
Section 536.8. A.  Every person who is licens ed pursuant to the 
provisions of the Registered Electrologist Act and who is licensed 
to practice electrolysis in this state shall register the license 
with the county clerk of the county in which said person has legal 
residence.  The county clerk to whom s uch license is presented shall 
register the name and address of the person designated in the 
license, together with the date and the number inscribed thereon, 
which record shall be open to the public, and shall file with t he

Board annually, during the mont h of February, a notice of the record 
so made. 
B. Every person who is licensed pursuant to the provisions of 
the Registered Electrologist Act to practice electrolysi s in this 
state shall keep said license displayed in his place of business as 
long as he is engaged in the practice of electrolysis.  The receipt 
for the annual renewal of license shall be kept at such person’s 
place of business and shall be shown to any p erson requesting to see 
the same.  The licensee shall ke ep the Board informed of his curre nt 
address.  A license issued by the Board is the property of the Board 
and shall be surrendered on demand of th e Board. 
SECTION 2.     AMENDATORY     59 O.S. 2021, Section 30 40.13, is 
amended to read as follows: 
Section 3040.13. A.  The State Department of Health shall 
maintain a roster of each p erson licensed as a midwi fe in this 
state.  The roster shall contain for each licen sed midwife the 
information required on the informed ch oice and disclosure statement 
under Section 3040.10 of this title and other information the 
Department determines nece ssary to accurately identify each licensed 
midwife. The roster shall be a public d ocument available under the 
Oklahoma Open Records Act. 
B.  The Department shall provide each county clerk and each 
local registrar of births in a county with the name of eac h midwife 
practicing in the county.

C. Any data required to be submitted to the De partment pursuant 
to Shepherd’s Law shall not contain a ny personally identifying 
information of the client by the midwife and shall be considered 
confidential records collec ted for statistical information purposes 
only. 
SECTION 3.     REPEALER     59 O.S. 2021, Section 510, is hereby 
repealed. 
SECTION 4.  This act shall become effective November 1, 2023.
