AS INTRODUCED 
 
An Act relating to mental health services funding; 
requiring certain funding appropriation; requiring 
certain calculation of fu nding; requiring certain 
request issuance; requiring certain submission 
requirements by county governments; requiring certain 
annual reporting; amending 57 O.S. 2021, Section 631, 
which relates to the County Community Safety 
Investment Fund; providing fund s to the Department of 
Mental Health and Substance Abuse Services for 
certain distribution; requiring certain services 
listing; amending 57 O.S. 2021, Section 633 , which 
relates to appropriations to the Co unty Community 
Safety Investment Fund; modifying certain savings 
calculation responsibility; authorizing certain fund 
allocation; amending 57 O.S. 2021, Section 632, which 
relates to savings and averted costs; modifying 
certain savings and averted costs calculation 
responsibility; providing for codificatio n; and 
providing an effective date . 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 2-312 of Title 43A, unless there 
is created a duplication in numb ering, reads as follows: 
A. The Department of Mental Health and Substance Abuse S ervices 
shall be appropriated funds to provide g rants to county governments 
for the purpose of providing mental health services. The amount of

funding shall be based on the savings from the reduction of the 
number and length of incarcerations attributed to the enactment of 
State Question 780.  The Legislative Office of Fiscal Transparency 
shall calculate the annual dollar amount of savings. 
B. The Department of Mental Health and Substance Abuse S ervices 
shall issue a request for proposals by which cou nty governments or 
multi-county partnerships may apply for funds for the development 
and implementation of mental health and substance abuse 
rehabilitation, diversion from the criminal j ustice system, 
treatment, employment, or housing programs.  The request must 
include but is not limited to the proposed services , number of 
individuals to be served by the proposed services or programs, and 
the manner in which the services or programs will partner or be 
supported by local Department -contracted or -certified entities.  
Allocation of funds shall b e based on the total county popula tion. 
C. Interested county governments shall submit all necessary 
documents to meet the requirements outlined in the request for the 
proposal to be considered . The number of awards and funding amounts 
of each award will be at the discretion of the Department and will 
be based on total available funds, and items in subsection B of this 
section. 
D. The Department shall provide an annual report to the 
Legislature which includes the amo unt awarded to each county 
government and a summary of services provided by successful bidders.

SECTION 2.     AMENDATORY    57 O.S. 2021, Section 631, is 
amended to read as follows: 
Section 631. A.  There is hereby created in the Stat e Treasury 
a revolving fund to be designated the “County Community Safety 
Investment Fund”.  The fund shall be a continuing fund, not subject 
to fiscal year limitations, and shall consist of all mon ies received 
pursuant to Section 633 of Title 57 of the Ok lahoma Statutes. 
B.  All monies appropriated and accrui ng to the credit of the 
fund shall be budgeted and expended by the Office of Management and 
Enterprise Services for the sole purpose of providi ng funds to the 
Department of Mental Health and Substance Abuse Services in its 
annual budget to distribute within counties to provide community 
rehabilitative programming, including but not limited to mental 
health and substance abuse treatment and rehabilitation , education, 
supportive employment, healthc are, data collection, and related 
technology services.  Funds shall be disbur sed in proportion to 
county population, as reported in the most recent census. 
C.  Expenditures from the fund shall be made upon warrants 
issued by the State Treasurer against claims filed as prescribe d by 
law with the Director of the Office of Management and Enterprise 
Services for approval and payment. 
D.  The Director of the Office of M anagement and Enterprise 
Services Department of Mental Health and Substance Abuse Services 
shall promulgate rules ne cessary to implement the provisions of this

act, including listing qualifying evidence-based services eligible 
for funding to include b ut not be limited to mental health services, 
substance abuse treatment and rehabilitation, education, supportive 
employment, healthcare, data collection, and related technology 
services. 
SECTION 3.     AMENDATORY     57 O.S. 2021, Section 632, is 
amended to read as follows: 
Section 632. No later than July 31 of the year foll owing the 
effective date of this act, and no later than July 31 every year 
thereafter, the Office of Management and Ent erprise Services 
Legislative Office of Fiscal Transpa rency shall calculate the 
savings and averted costs that accrued to the state from t he 
implementation of the Oklahoma Smart Justice Reform Act.  In making 
the calculation required by this section, the Office of Management 
and Enterprise Services Legislative Office of Fiscal Transparency 
shall use actual data or best available estimates wh ere actual data 
is not available. The calculation shall be final and shall not be 
adjusted for any subsequent changes in the underlying data. 
SECTION 4.    AMENDATORY     57 O.S. 2021, Section 633, is 
amended to read as follows: 
Section 633. An amount equal to the savings calculated by the 
Office of Management and Enterprise Services Legislative Office of 
Fiscal Transparency pursuant to Section 632 of Ti tle 57 shall, 
subject to appropriation by the Legisl ature, be paid to the County

Community Safety Investment Fund for allocation by the Departme nt of 
Mental Health and Substance Abuse Services within counties. 
This section is intended to comply with, and i s subject to, 
Article V, Section 55, Article VI, Sec tion 12, Article X, Section 
23, and the other applicable provisions of the Oklahoma 
Constitution. 
SECTION 5.  This act shall beco me effective November 1, 2023.
