AS INTRODUCED
An Act relating to the Oklahoma Public Employees
Retirement System; amending 74 O.S. 2021, Section
911, which relates to employee members; allowing
certain employees to opt out of certain System
participation; and updating statutory language .
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 74 O.S. 2021, Section 911, is
amended to read as follows:
Section 911. (1) A. Any employee of a participatin g employer
on the entry date of such employer shall be a member of the System
on the entry date.
(2) B. Any employee other than a state elected official who is
employed by a participating employer after the entry date of such
employer shall be a member of the System on the first day of the
month immediately following employment. Provided, any employee of a
participating employer shall have the option to opt out of
participating in the System’s defined contribution with no penalty.

(3) C. Any employee who is in military service or on leave of
absence on the entry date of his employer shall become a member of
the System upon his return to active employment.
