BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Sectio n 1-708a of Title 63, unless there is created a duplication in numbering, read s as follows: A. As used in this section: 1. “Surgical smoke” means the gaseous by -product, including surgical plume, smoke plume, bio -aerosols, laser-generated airborne contaminants, and lung-damaging dust, produced by an energy - generating device used in a room in which a surgical procedure is performed; and 2. “Surgical smoke evacuation system ” means equipment designed to capture and neutralize surgical smoke at the site of o rigin and before the surgical smoke makes contact with the eyes or respiratory Req. B. A hospital or ambulatory surgical center licensed by the State Department of Health shal l adopt and implement a policy to prevent an individual ’s exposure to surgical smoke through the use of a surgical smoke evacuation system during each planned surgical procedure that is likely to generate surgical smoke.
