A BILL FOR AN ACT Relating to policies for the use of automated external defibrillators at schools; creating new pro- visions; amending ORS 339.345; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. ORS 339.345 is amended to read: 339.345. [Each school campus in a school district, private school campus and public charter school campus shall have on the premises at least one automated external defibrillator.] (1) As used in this section: (a) “Athletic venue” means any location in a building or on the grounds of any kindergarten through grade 12 public or private school where athletic practices or competi- tions are held for school-sponsored events or for which students are in attendance. (b) “Coach” has the meaning given that term in ORS 336.485. (c) “School” means the buildings and grounds of any kindergarten through grade 12 public or private school, excluding athletic venues. (2) The governing body for a school shall ensure that: (a) Automated external defibrillators are located: (A) At each school at locations that are selected, to the greatest extent practicable, in accordance with guidelines established by a national organization focused on emergency cardiovascular care; and (B) At each athletic venue. (b) The automated external defibrillator location is clearly identified and is unlocked and accessible: (A) For automated external defibrillators located in a school, when students are at the school;and (B) For automated external defibrillators located at an athletic venue, when students are NOTE:Matter in boldfaced type in an amended section is new; matter [italic and bracketed] is existing law to be omitted. (c) Automated external defibrillators are tested and maintained as provided by the manufacturer’sguidelines. (d) Every coach is trained in the use of automated external defibrillators. (e) The ratio of the number of students to the number of staff members who are trained in the use of automated external defibrillators is the same as the ratio prescribed for staff members who hold a first aid card under ORS 342.664. (3) Training required under subsection (2) of this section must align with guidelines es- tablished by a national organization focused on emergency cardiovascular care and may be provided as part of first aid training required under ORS 342.664. (4) Any school plan for responding to medical emergencies must include: (a) A plan for cardiac emergency responses, including the use of automated external defibrillators, that aligns with core elements established by a national organization focused on emergency cardiovascular care; and (b) Identification of the locations of automated external defibrillators, which must be shared with emergency medical services providers. SECTION 2. (1) The amendments to ORS 339.345 by section 1 of this 2025 Act become operative July 1, 2026. (2) The amendments to ORS 339.345 by section 1 of this 2025 Act first apply to the 2026-2027 school year. SECTION 3.In addition to and not in lieu of any other appropriation, there is appropri- ated to the Department of Education, for the biennium beginning July 1, 2025, out of the General Fund, the amount of $2,000,000, which may be distributed to school districts and public charter schools to assist in implementing the provisions of ORS 339.345, as amended by section 1 of this 2025 Act, with priority given to schools with the highest financial needs. SECTION 4.This 2025 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2025 Act takes effect July 1, 2025. [2]
