HOUSE COMMITTEE ON APPROPRIATIONS FISCAL NOTE HOUSE BILL NO. 27 PRINTER’ S NO. 8 PRIME SPONSOR: Khan COST I (SAVINGS) FUND FY 2024/25 FY 2025/26 General Fund $0 $0 SUMMARY: Amends the Health Care Facilities Act to require hospitals and ambulatory surgical facilities to mitigate exposure to surgical smoke generated during procedures. ANALYSIS: House Bill 27, Printer’s Number 8 amends Act 48 of 1979, known as the Health Care Facilities Act, to require hospitals and ambulatory surgical centers to adopt and implement policies to mitigate exposure to surgical smoke through the use of a smoke evacuation system for each procedure that generates surgical smoke. The facility must develop the policy in consultation with the entire surgical team at the facility. The requirements in this legislation will take effect for hospitals and ambulatory surgical centers on or before January 1, 2026 , or 90 days after the effective date of this legislation , whichever is later. This legislation will take effect immediately upon enactment . FISCAL IMPACT: This legislation has no fiscal impact on c ommonwealth funds as it requires hospitals and ambulatory surgical centers to implement policies to prevent exposure to surgical smoke.
