HOUSE COMMITTEE ON APPROPRIATIONS FISCAL NOTE HOUSE BILL NO. 291 PRINTER’ S NO. 226 PRIME SPONSOR: Daley COST I (SAVINGS) FUND FY 2024/25 FY 2025/26 Motor License Fund See Fiscal Impact See Fiscal Impact SUMMARY: HB 291 PN 226 authorizes municipalities to create parking-protected bicycle lanes between curbs and parked vehicles. ANALYSIS: This legislation amends Title 75 (Vehicles) Section 3354 (Additional parking requirements) to create Subsection b.1 (Protected pedestrian plazas and pedalcycle lanes ). Specifically: Section 3354 (b.1) provides that, in cases where there is on-street pedestrian plaza or bicycle lane, parked vehicles must be positioned in the direction of authorized traffic, depending on whether they are next to the right or left-hand curb The bill further articulates that the language within Section 3354 (b.1) shall not prevent a local authority from enacting parking regulations Legislation includes a penalty for violating Section 3354 (b.1) by making it a summary offense and a fine of up to $15 FISCAL IMPACT: The enactment of this legislation would have a minimal fiscal impact on commonwealth funds, specifically the Motor License Fund. The impact of the fines deposited into the Motor License Fund would be a function of the number of violations which occur. At this time, that number is indeterminate.
