HOUSE COMMITTEE ON APPROPRIATIONS FISCAL NOTE HOUSE BILL NO. 404 PRINTER’ S NO. 376 PRIME SPONSOR: Pashinski COST I (SAVINGS) FUND FY 2024/25 FY 2025/26 Insurance Regulation and Oversight Fund $0 $0 SUMMARY: This legislation provides for health insurance coverage of dependent children up to age twenty- six by a parent’s health insurance policy. ANALYSIS: House Bill 404, Printer’s Number 376 amends Act 284 of 1921, known as The Insurance Company Law of 1921, to provide health insurance coverage for children up to age twenty-six through a parent’s health insurance policy. Covered dependent children include unmarried children incapable of self-sustaining employment due to an intellectual or physical disability. This legislation requires the Insurance Commissioner to transmit notice to the Legislative Reference Bureau for publication in the next available issue of the Pennsylvania Bulletin if federal regulations that currently provide for this coverage of children on a parent’s health insurance policy are repealed, abrogated, vacated, or invalidated, or if the executive branch of the United States refuses to enforce or repeals these federal regulations. The requirement for the Insurance Commissioner to transmit this notice takes effect immediately upon the enactment of this legislation. The remainder of the legislation takes effect upon publication of the notice. FISCAL IMPACT: The Department of Insurance oversees the health insurance companies’ compliance with requirements included in this legislation. Currently, t he department does not anticipate any increase in administrative costs which are funded through the Insurance Regulation and Oversight Fund. Therefore, there is no adverse fiscal impact to the commonwealth from the enactment of this legislation.
