ANALYSIS: House Bill 491 Printer’s Number 1294 amends Title 42 to insert section 6329 (Concurrent jurisdiction on military installations). The inserted section establishes concurrent jurisdiction between commonwealth and federal courts over proceedings involving a violation of f ederal law committed by a child on a military installation of the United States Department of Defense. Concurrent jurisdiction is only established if the federal court, or an attorney authorized to make decisions on behalf of the United States, waives exclusive jurisdiction and the violation is also a crime under c ommonwealth laws. This legislation would take effect immediately upon enactment. FISCAL IMPACT: Enactment of this legislation will have no impact on commonwealth funds.
