Establishes certain offenses based on homicide due to criminal sale of a controlled substance; establishes the offense of criminal sale of a controlled substance to a child in the first degree; expands the definition of controlled substances with respect to certain offenses; increases the felony classification of certain controlled substance offenses; includes electronic prescriptions and blank prescription forms in the definition of certain controlled substance offenses.
Alters the definition of "drug" in the vehicle and traffic law to include any substance or combination of substances that impair, to any extent, physical or mental abilities; defines impairment and intoxication; provides that refusal to submit to a breath test and/or oral/bodily fluid test shall be a traffic infraction; makes related provisions.
Allows for unlicensed personnel to administer certain seizure rescue medication in schools, on school grounds and at school events; provides that such medicine may be left with a school health official to be used as needed.
Adds offenses to disorderly conduct, including urination and defecation in a public place; smoking any substance in a prohibited area; possessing an open container of alcohol in a public place; smoking marijuana in a public place; or disobeying signage, including but not limited to, printed notices and placards, in any municipal or state park.
Authorizes the department of transportation to establish and implement a state memorial sign program to memorialize persons who died due to injuries sustained in a fatal motor vehicle crash on state highways.
Provides for family members of a crime victim and interested parties to make statements to members of the parole board; provides that such oral statement shall be made to the members of the state board of parole who will determine whether the defendant is released.
Establishes a small business tax credit for certain efforts taken to improve such small business's facility in an effort to reduce the spread of infectious diseases.
Enhances penalties for aggravated cruelty to animals by making such offense a felony, including torture, beating, or killing of any animal; makes animal cruelty, including overdriving or depriving an animal of sustenance a felony when committed while released on recognizance for violating an order of protection; allows aggravated animal abuse to be considered for bail.
Designates all agents employed by the city of New York police department in the titles of traffic enforcement agent I and traffic enforcement agent II as peace officers.
Provides motor fuel tax exemption for sales of diesel motor fuel used in vessels used directly in a business providing sport fishing opportunities for hire to the general public from the tax on petroleum businesses and from sales and compensating use taxes.
Establishes the crime of aggravated obstructing emergency medical services for conduct which obstructs the efforts of certain emergency services, personnel or systems while obstructing traffic or posing a risk of serious physical injury; permits forfeiture.
Authorizes the village of North Haven, county of Suffolk, to reduce the maximum speed limit along certain designated streets in such village to not less than twenty miles per hour.
