Authorizes a certain property operating as a private membership establishment to sell alcohol for on-premises consumption to members and their guests; defines "private membership establishment"; provides that such provisions shall not be interpreted to authorize any form of discrimination.
Permits structures to remain where the local permitting authority has issued a permit for construction built within an erosion hazard area or tidal wetland adjacent area prior to the effective date of the amendments.
Relates to creating a respiratory therapy demonstration program for residential health care facilities; authorizes the commissioner of health approve up to ten residential health care facilities within the state to operate respiratory therapy units.
Provides that court records in a proceeding under articles 77, 78 and 81 of the mental hygiene law shall not be perused, examined, disclosed, taken or copied by any other person than a party, the attorney or counsel of a party, the guardian, the court evaluator or the court examiner except by order of the court.
Prohibits public food service establishments operating in the state from providing excess food service items including utensils, condiments, napkins and extra containers, to any customer except upon, and in accordance with, the express request of that customer.
Directs the department of public service to promulgate rules, regulations and model policies regarding setback requirements for the siting of battery energy storage systems and for financial surety requirements; requires minimum setback requirements for commercial energy storage systems, with a capacity of five megawatts or greater, of no less than one thousand feet from residential property; requires public hearings prior to the approval of an application for a permit for such systems.
Relates to protecting the communication rights of individuals with disabilities; provides that each person with a disability has the right to communicate in their preferred manner.
Provides for securities fraud whistleblower incentives and protections; defines terms; grants whistleblower awards for one or more whistleblowers who voluntarily provide original information to the attorney general that was the basis for a successful covered enforcement action; protects whistleblowers from retaliation; authorizes the attorney general to adopt any necessary rules and regulations; makes related provisions.
