Removes the requirement that consent for the payment of certain medical services must occur after such services are administered; requires the superintendent of financial services and the commissioner of health to develop a uniform form for consent for payment.
Enacts the "state taxpayer oversight and protection (STOP) act"; relates to the payment of attorneys' fees by the state; provides that no attorneys' fees or expenses shall be paid if incurred on behalf of an employee in any action brought by the employee against the state; provides that attorneys' fees shall be presumptively unreasonable where an individual hires or employs multiple law firms on the same matter unless such employee can demonstrate the need for additional attorneys with distinct subject matter expertise.
Establishes the New York state commission to end mass incarceration and to prevent violence; provides such commission shall investigate, evaluate and make recommendations concerning how to reduce the New York prison population, incidences of violent crime in New York state, and other various topics related to the criminal justice system.
Grants immunity from liability and professional retaliation against a law enforcement employee who intervenes against police misconduct committed by another member of law enforcement.
Establishes the civil right to counsel in eviction proceedings in New York state; creates the New York state office of civil representation; requires that covered individuals be given notice of such right to counsel.
Includes a police or peace officers turning off their body camera or deleting a body camera recording in the crime of tampering with physical evidence.
Provides for the employment of school nurses for the inspection of pupils attending certain public schools; relates to school districts and boards of cooperative educational services.
Establishes the healthy and safe students act; requires comprehensive sexuality instruction for students in grades K-12 which includes a model curricula for comprehensive sexuality education and at a minimum conforms to the content and scope of national sexuality education standards.
Establishes the "reciprocal enforcement of claims on unpaid or reduced state entitlements act" which requires a report on delinquent funds owed to the state by the federal government as a result of the federal government's nonpayment in contravention of a court decision and the withholding and appropriation of federal funds in an amount equal to.
Relates to the establishment of emergency management release plans to be developed for use in correctional facilities in the event of a state disaster emergency declared pursuant to executive order; establishes an advisory board to provide recommendations for the development of such plans; establishes criteria to be used to determine eligibility for emergency release of incarcerated individuals.
Prohibits participation in torture and improper treatment of incarcerated individuals by health care professionals; prohibits a health care professional from engaging, assisting or planning the torture or improper treatment of an incarcerated individual; requires health care professionals to report torture and improper treatment.
