Relates to providing free use of state parks for certified first responders who participated in the rescue effort at the World Trade Center on September 11, 2001.
Provides an exemption for the sale of the first $35,000 for a battery, electric, or plug-in hybrid electric vehicle from state sales and compensating use taxes; authorizes local governments to elect such incentives; repeals the hybrid exemption after ten years.
Permits judicial discretion based on dangerousness when issuing a securing order; allows for limited pre-trial detention upon such a determination; extends the time period for discovery from twenty to forty-five days; permits the immediate issuance of a bench warrant for failure to appear for certain principals charged with hate crimes; places restrictions on when appearance tickets may be issued.
Relates to qualifying offenses for pre-trial detention; adds class B felonies under article two hundred twenty of the penal law as qualifying offenses.
Enacts the "learning for work act"; establishes the youth apprenticeship program and the enhanced regents professional diploma; appropriates moneys therefor.
Establishes a coordinated law enforcement adult rescue "teal alert" for missing adults; provides that local law enforcement agencies notify the division of criminal justice services about missing adults; provides that such division shall issue an alert about such missing adult.
Relates to protecting witnesses in criminal prosecutions from intimidation and threats by permitting the court to withhold disclosure of names and other information if the court finds on the record that such witness is subject to potential intimidation, violence or threats.
Establishes the 15 member New York Asian American and Pacific Islander commission to develop policies to improve the community, economic and social well-being, and the health and educational needs important to Asian American and Pacific Islander communities in the state; to develop and coordinate statewide programs, recognizing the continuing contributions of Asian American and Pacific Islander individuals in the state; to create and implement public education campaigns regarding Asian American and Pacific Islander issues and culture; to increase the awareness among Asian American and Pacific Islander individuals of state and local resources that may benefit Asian American and Pacific Islander individuals and communities as a whole; and to undertake any other activities the commission deems necessary and applicable to support Asian American and Pacific Islander communities in the state.
Establishes the warehouse worker injury reduction program; requires employers to establish an injury reduction program designed to identify and minimize the risks of musculoskeletal injuries and disorders among workers involved in performing manual materials handling tasks.
Relates to the number of signatures for independent nominating petitions; decreases the number of signatures and votes to 15,000 signatures for statewide candidates and 50,000 votes to maintain party ballot status; changes the petition period to 12 weeks and the petitioning time to May-August.
Establishes a civil cause of action for employees who are subjected to an abusive work environment; employers shall be vicariously liable for such work environment.
Requires the court to consider a child's health and safety when making a decision regarding child custody and visitation; directs the court to review certain information as it relates to allegations of child abuse, domestic violence and child safety; requires the court to appoint an attorney to represent the child when credible allegations of serious risk to the child's safety have been made.
