Requires instruction in arts and music education to be incorporated into curriculums for all public school students; requires school districts to ensure that appropriately certified teachers are providing such education; authorizes rules and regulations consistent with such provisions.
Clarifies provisions regarding the use of crossbows for hunting, allowing the department of environmental conservation to allow the use of crossbows for the taking of big game in any area long bows are permitted.
Enacts "Killian's law"; establishes a timely repair for wheelchair program; extends the warranty period for wheelchairs to 2 years; deems all wheelchair repairs needed within 5 years of initial prescription medically necessary.
Enacts the "ratepayer disclosure and transparency act" which requires a monthly report that includes the estimated or actual ratepayer costs and benefits of any mandated state energy program to the governor and legislature including any New York climate leadership and community protection act compliance costs.
Establishes a senior housing task force for the purposes of conducting a state-wide assessment of senior housing needs taking into consideration the various geographical areas and different needs of the seniors in those areas and resources available in those different areas.
Relates to procedures relating to driving while ability impaired by drugs; defines impairment and intoxication; updates procedures for field testing of drivers suspected of being under the influence of drugs to include the use of oral/bodily fluid tests; provides that refusal to submit to such field tests is specified to be a traffic infraction; makes related provisions.
Establishes a person is guilty of arson in the first degree when such person intentionally damages a building or motor vehicle by causing an explosion or a fire and when such explosion or fire is accelerated by use of ignitable liquid or flammable gas.
Establishes procurement goals that certain percentages of all food and food products purchased by state agencies shall be New York state food products.
Amends provisions relating to removing the exemption for school psychologists to render early intervention services, in relation to the effectiveness thereof.
Prohibits landlords from restricting the installation of appliances or fixtures by tenants; provides that the landlord is not compelled to change utilities for such installation; prohibits surcharge where tenant pays utilities directly to provider; requires a tenant restore appliances or fixtures to the condition they were prior to being installed or allowing such appliances or fixtures remain in the rental unit at no cost to the landlord; defines "appliances or fixtures".
Increases the rate paid by the state to a city for maintenance and repair of highways by the percentage change in the consumer price index for all urban consumers (CPI-U), New York-Northern New Jersey-Long Island, NY-NJ-CT-PA, as published by the United States department of labor bureau of labor statistics, over the prior five years.
Relates to insurance fraud; provides a provision for compensation to a person that reports insurance fraud to the authorities; establishes crimes of unlawful procurement of clients, patients or customers; aggravated insurance fraud in the second degree; and aggravated insurance fraud in the first degree; provides that this act also increases the penalty for insurance fraud; appropriates $3,100,000 therefor.
