Authorizes the city of Syracuse to establish a demonstration program imposing monetary liability on the owner of a vehicle for failure of an operator thereof to comply with posted maximum speed limits in a school speed zone.
Extends provisions relating to establishing the stretch limousine passenger safety task force; authorizes the stretch limousine passenger safety task force to continue to hold public hearings and meetings to review the actions taken by the state and to publish a report of its findings.
Requires the commissioner of transportation to report on collisions that have occurred between motor vehicles and bridges or elevated structures on or crossing highways under the jurisdiction of the department of transportation in the annual report to the legislature.
Requires the central New York regional market authority to work with the department of agriculture and markets to assure proper development of agriculture and regional market facilities, in the Central New York Regional Market district; requires such authority to furnish an annual real estate report detailing all real estate holdings and detailed property information, including but not limited to the tenants, important lease terms, rents, durations of leases, as well as copies of each lease; authorizes the state comptroller to examine the accounts and books of the authority; makes related provisions.
Requires town and village justices be admitted to the practice of law in this state and reside in the municipality in which the position is located; provides an exception to the requirement for currently serving justices; provides for the office of court administration to grant a waiver of the requirements.
Provides that when a housing accommodation has been vacated after continuous tenancy or occupancy of ten years or more prior to vacancy, and the owner can demonstrate restoration of the unit, the new legal regulated rent shall be the rent agreed to by the owner and first tenant after such restoration and reserved in a lease or other rental agreement; makes related provisions.
Relates to permissible activities for athletic associations, conferences, or other groups or organizations with authority over intercollegiate athletics and to the definition of student-athlete; makes a technical change.
Establishes a school ventilation and energy efficiency assessment, repair and verification program to require each school to: obtain an HVAC Assessment Report performed by qualified testing personnel documenting the functionality of the existing system or lack thereof, and obtain a report from a mechanical engineer identifying any upgrades, replacements or other measures recommended to improve the functionality, health and safety and/or energy efficiency of the HVAC system; adjust, and, if necessary, repair existing building HVAC systems, and install or replace HVAC systems, if necessary, to ensure proper and efficient operation, as well as compliance with health and safety standards; obtain an HVAC Verification Report performed by qualified testing personnel documenting any upgrades, replacements, installations or any other work performed on the HVAC system functions as designed and/or in compliance with health and safety standards; install CO2 sensors in classrooms, assembly areas, kitchen or cafeteria areas or building office spaces to provide ongoing verification that proper ventilation is maintained during operation; makes related provisions.
Provides that contract cost adjustments in the middle of contract terms for school districts transportation contracts shall be at no additional cost to the state, locality or school district unless such amendment is necessary to comply with the statewide transition to zero-emission buses and provided that it has been established by the contractor that there has been at least an equivalent increase in the amount of such contractor's cost of operation.
Relates to claim settlement practices when an insurer refuses to pay or is delaying payment of a settlement; provides a policyholder a private right of action against such insurer doing business in the state who has refused or delayed payment of an insurance claim.
