RELATING TO MOTOR AND OTHER VEHICLES -- INSPECTION OF MOTOR VEHICLES

It is enacted by the General Assembly as follows: 
SECTION 1. Section 31-38-1 of the General Laws in Chapter 31-38 entitled "Inspection 1 
of Motor Vehicles" is hereby amended to read as follows: 2 
31-38-1. Vehicles without required equipment or in unsafe condition — Inspection 3 
sticker for used cars for sale required. 4 
(a) No person shall sell at retail, drive, or move on any highway any motor vehicle, trailer, 5 
semitrailer, or pole trailer or any combination of them unless the equipment upon the vehicle is in 6 
good working order and adjustment as required in this title, and the vehicle is in such safe 7 
mechanical condition as not to endanger the driver or other occupant or any person upon the 8 
highway. 9 
(b) No dealer of used vehicles, as defined by § 31-1-19(b), shall sell at retail a used motor 10 
vehicle unless a new inspection of the vehicle conforming to the standards set pursuant to this 11 
chapter and chapter 47.1 of this title has been conducted and the vehicle has a new certificate of 12 
inspection affixed to the windshield at the time of sale, except used cars sold: 13 
(1) Sold “for parts only” and clearly identified accordingly on the bill of sale: or 14 
(2) Purchased at the end of the lease term by the current lessee with a valid certificate of 15 
inspection affixed to the windshield at the time of sale that is issued by the state where the vehicle 16 
is currently registered, provided a certificate of inspection is not required if there is not a vehicle 17 
inspection requirement in the state of current registration.  18

SECTION 2. This act shall take effect six (6) months after the effective date of this act. 1

BY THE LEGISLATIVE COUNCIL

RELATING TO MOTOR AND OTHER VEHICLES -- INSPECTION OF MOTOR VEHICLES

This act would exempt used vehicles sold "for parts only", or vehicles purchased at the end 1 
of their lease term by the current lessee that have a valid certificate of inspection affixed to the 2 
windshield, from the requirement that dealers of used vehicles conduct a new inspection prior to 3 
the sale of a used vehicle. 4 
This act would take effect six (6) months after the effective date of this act.  5
