It is enacted by the General Assembly as follows: 
SECTION 1. Section 21-28-2.08 of the General Laws in Chapter 21-28 entitled "Uniform 1 
Controlled Substances Act" is hereby amended to read as follows: 2 
21-28-2.08. Contents of schedules. 3 
Schedules I through V shall consist of the drugs and other substances, by whatever official 4 
name, common or usual name, chemical name, or brand name designated, listed in the 5 
corresponding section, or designated by the director of the department of health pursuant to § 21-6 
28-2.01. 7 
Schedule I 8 
(a) Schedule I shall consist of the drugs and other substances, by whatever official name, 9 
common or usual name, chemical name, or brand name designated, listed in this section. 10 
(b) Opiates. Unless specifically excepted or unless listed in another schedule, any of the 11

compounds of these structures, regardless of numerical designation of atomic positions covered). 22 
(18) Thiophene analog of phencyclidine. 1-(1-(2 thienyl) cyclo-hexyl) pipiridine: 2-23

(19) 2,5 dimethoxyamphetamine 25

plant, and any compound, salt derivative, or mixture of the plant or its extracts. This shall not mean 5 
the unaltered plant. 6 
(e)(d) Depressants. Unless specifically excepted or unless listed in another schedule, any 7 
material, compound, mixture, or preparation that contains any quantity of the following substances 8 
having a depressant effect on the central nervous system, including its salts, isomers, and salts of 9 
isomers whenever the existence of the salts, isomers, and salts of isomers is possible within the 10 
specific chemical designation: 11 
(1) Mecloqualone. 12 
(2) Methaqualone. 13 
(3) 3-methyl fentanyl (n-(3methyl-1(2-phenylethyl)-4-piperidyl)-N-phenylpropanamide. 14 
(4) 3,4-methyl-enedioxymethamphetamine (MDMA), its optical, positional, and geometric 15 
isomers, salts, and salts of isomers. 16 
(5) 1-methyl-4-phenyl-4-propionoxypiperidine (MPPP), its optical isomers, salts, and salts 17

(6) 1-(2-phenylethyl)-4-phenyl-4-acetyloxypiperidine (PEPAP), its optical isomers, salts, 19

(1) 5-(1,1-Dimethylheptyl)-2-[(1R,3S)-3-hydroxycyclohexyl]-phenol (CP-47,497) 20 
(2) 5	-(1,1-Dimethyloctyl)-2-[(1R,3S)-3-hydroxycyclohexyl]-phenol 21 
(cannabicyclohexanol and CP-47,497 c8 homologue) 22 
(3) 1-Butyl-3-(1 naphthoyl)indole, (JWH-073) 23 
(4) 1-[2-(4-Morpholinyl)ethyl]-3-(1-naphthoyl)indole (JWH-200) 24 
(5) 1-Pentyl-3-(1-napthoyl)indole, (JWH-018 and AM678) 25 
(h)(g) Synthetic cannabinoids or piperazines. Unless specifically excepted, any chemical 26 
compound which is not approved by the United States Food and Drug Administration or, if 27 
approved, which is not dispensed or possessed in accordance with state and federal law, that 28 
contains Benzylpiperazine (BZP); Trifluoromethylphenylpiperazine (TFMPP); 1,1-29 
Dimethylheptyl-11-hydroxytetrahydrocannabinol (HU-210); 1-Butyl-3-(1-naphthoyl) indole; 1-30 
Pentyl-3-(1-naphthoyl) indole; dexanabinol (HU-211); or any compound in the following structural 31 
classes: 32 
(1) Naphthoylindoles: Any compound containing a 3-(1-naphthoyl)indole structure with 33 
substitution at the nitrogen atom of the indole ring by an alkyl, haloalkyl, alkenyl, 34

cycloalkylmethyl, cycloalkylethyl, 1-(N-methyl-2-piperidinyl)methyl, or 2-(4-morpholinyl)ethyl 1 
group, whether or not further substituted in the indole ring to any extent and whether or not 2 
substituted in the naphthyl ring to any extent. Examples of this structural class include, but are not 3 
limited, to JWH-015, JWH-018, JWH-019, JWH-073, JWH-081, JWH-122, JWH-200, and AM-4 
2201; 5 
(2) Phenylacetylindoles: Any compound containing a 3-phenylacetylindole structure with 6 
substitution at the nitrogen atom of the indole ring by an alkyl, haloalkyl, alkenyl, 7 
cycloalkylmethyl, cycloalkylethyl, 1-(N-methyl-2-piperidinyl)methyl, or 2-(4-morpholinyl)ethyl 8 
group whether or not further substituted in the indole ring to any extent and whether or not 9 
substituted in the phenyl ring to any extent. Examples of this structural class include, but are not 10 
limited to, JWH-167, JWH-250, JWH-251, and RCS-8; 11 
(3) Benzoylindoles: Any compound containing a 3-(benzoyl) indole structure with 12 
substitution at the nitrogen atom of the indole ring by an alkyl, haloalkyl, alkenyl, 13 
cycloalkylmethyl, cycloalkylethyl, 1-(N-methyl-2-piperidinyl)methyl, or 2-(4-morpholinyl)ethyl 14 
group whether or not further substituted in the indole ring to any extent and whether or not 15 
substituted in the phenyl ring to any extent. Examples of this structural class include, but are not 16 
limited, to AM-630, AM-2233, AM-694, Pravadoline (WIN 48,098), and RCS-4; 17 
(4) Cyclohexylphenols: Any compound containing a 2-(3-hydroxycyclohexyl)phenol 18 
structure with substitution at the 5-position of the phenolic ring by an alkyl, haloalkyl, alkenyl, 19 
cycloalkylmethyl, cycloalkylethyl, 1-(N-methyl-2-piperidinyl)methyl, or 2-(4-morpholinyl)ethyl 20 
group whether or not substituted in the cyclohexyl ring to any extent. Examples of this structural 21 
class include, but are not limited to, CP 47,497 and its C8 homologue (cannabicyclohexanol); 22 
(5) Naphthylmethylindoles: Any compound containing a 1H-indol-3-yl-(1-naphthyl) 23 
methane structure with substitution at the nitrogen atom of the indole ring by an alkyl, haloalkyl, 24 
alkenyl, cycloalkylmethyl, cycloalkylethyl, 1-(N-methyl-2-piperidinyl)methyl, or 2-(4-25 
morpholinyl)ethyl group whether or not further substituted in the indole ring to any extent and 26 
whether or not substituted in the naphthyl ring to any extent. Examples of this structural class 27 
include, but are not limited to, JWH-175, JWH-184, and JWH-185; 28 
(6) Naphthoylpyrroles: Any compound containing a 3-(1-naphthoyl)pyrrole structure with 29 
substitution at the nitrogen atom of the pyrrole ring by an alkyl, haloalkyl, alkenyl, 30 
cycloalkylmethyl, cycloalkylethyl, 1-(N-methyl-2-piperidinyl)methyl, or 2-(4-morpholinyl)ethyl 31 
group whether or not further substituted in the pyrrole ring to any extent and whether or not 32 
substituted in the naphthyl ring to any extent. Examples of this structural class include, but are not 33 
limited, to JWH-030, JWH-145, JWH-146, JWH-307, and JWH-368; 34

(7) Naphthylmethylindenes: Any compound containing a 1-(1-naphthylmethyl)indene 1 
structure with substitution at the 3-position of the indene ring by an alkyl, haloalkyl, alkenyl, 2 
cycloalkylmethyl, cycloalkylethyl, 1-(N-methyl-2-piperidinyl)methyl, or 2-(4-morpholinyl)ethyl 3 
group whether or not further substituted in the indene ring to any extent and whether or not 4 
substituted in the naphthyl ring to any extent. Examples of this structural class include, but are not 5 
limited to, JWH-176; or 6 
(8) Any other synthetic cannabinoid or piperazine which is not approved by the United 7 
States Food and Drug Administration or, if approved, which is not dispensed or possessed in 8 
accordance with state and federal law. 9 
(i) Synthetic cathinones. Unless specifically excepted, any chemical compound which is 10 
not approved by the United States Food and Drug Administration or, if approved, which is not 11 
dispensed or possessed in accordance with state and federal law, not including bupropion, 12 
structurally derived from 2-aminopropan-1-one by substitution at the 1-position with either phenyl, 13 
naphthyl, or thiophene ring systems, whether or not the compound is further modified in one or 14 
more of the following ways: 15 
(1) By substitution in the ring system to any extent with alkyl, alkylenedioxy, alkoxy, 16 
haloalkyl, hydroxyl, or halide substituents, whether or not further substituted in the ring system by 17 
one or more other univalent substituents. Examples of this class include, but are not limited to, 3,4-18 
Methylenedioxycathinone (bk-MDA); 19 
(2) By substitution at the 3-position with an acyclic alkyl substituent. Examples of this 20 
class include, but are not limited to, 2-methylamino-1-phenylbutan-1-one (buphedrone); 21 
(3) By substitution at the 2-amino nitrogen atom with alkyl, dialkyl, benzyl, or 22 
methoxybenzyl groups, or by inclusion of the 2-amino nitrogen atom in a cyclic structure. 23 
Examples of this class include, but are not limited to, Dimethylcathinone, Ethcathinone, and α-24 
Pyrrolidinopropiophenone (α-PPP); or 25 
(4) Any other synthetic cathinone which is not approved by the United States Food and 26 
Drug Administration or, if approved, is not dispensed or possessed in accordance with state or 27 
federal law. Examples of this class include, but are not limited to, Ephylone and Pentylone. 28 
Schedule II  29 
(a) Schedule II shall consist of the drugs and other substances, by whatever official name, 30 
common or usual name, chemical name, or brand name designated, listed in this section. 31 
(b) Substances, vegetable origin, or chemical synthesis. Unless specifically excepted or 32 
unless listed in another schedule, any of the following substances whether produced directly or 33 
indirectly by extraction from substances of vegetable origin, or independently by means of 34

chemical synthesis, or by a combination of extraction and chemical synthesis: 1 
(1) Opium and opiate, and any salt, compound, derivative, or preparation of opium or 2 
opiate excluding naloxone and its salts, and excluding naltrexone and its salts, but including the 3 
following: 4 
(i) Raw opium 5 
(ii) Opium extracts 6 
(iii) Opium fluid extracts 7 
(iv) Powdered opium 8 
(v) Granulated opium 9 
(vi) Tincture of opium 10 
(vii) Etorphine hydrochloride 11 
(viii) Codeine 12 
(ix) Ethylmorphine 13 
(x) Hydrocodone 14 
(xi) Hydromorphone 15 
(xii) Metopon 16 
(xiii) Morphine 17 
(xiv) Oxycodone 18 
(xv) Oxymorphone 19 
(xvi) Thebaine 20 
(2) Any salt, compound, derivative, or preparation that is chemically equivalent or identical 21 
with any of the substances referred to in subdivision (1) of this subsection, except that these 22 
substances shall not include the isoquinoline alkaloids of opium. 23 
(3) Opium poppy and poppy straw. 24 
(4) Coca leaves and any salt, compound, derivative, or preparation of coca leaves, and any 25 
salt, compound, derivative, or preparation that is chemically equivalent or identical with any of 26 
these substances, except that the substances shall not include decocainized coca leaves or extraction 27 
of coca leaves, which extractions do not contain cocaine or ecgonine. 28 
(5) Concentrate of poppy straw (the crude extract of poppy straw in liquid, solid, or powder 29 
form that contains the phenanthrine alkaloids of the opium poppy). 30 
(c)(b) Opiates. Unless specifically excepted or unless listed in another schedule, any of the 31 
following opiates, including its isomers, esters, ethers, salts; and salts of isomers, esters, and ethers 32 
whenever the existence of the isomers, esters, ethers, and salts is possible within the specific 33

This act would provide that Schedules I through V of the Uniform Controlled Substances 1 
Act consist of drugs and other substances, by whatever official name, common or usual name, 2 
chemical name or name designated by the director of the department of health, and would add 3 
several new drugs to various schedules, including Etizolam, Flubromazolam, Tramadol, Zolpidem, 4 
and Xylazine HCL. 5
