RELATING TO PUBLIC PROPERTY AND WORKS -- STATE PURCHASES

It is enacted by the General Assembly as follows:
SECTION 1. Section 37-2-22 of the General Laws in Chapter 37-2 entitled "State 1
Purchases" is hereby amended to read as follows: 2
37-2-22. Small purchases. 3
Procurements, not to exceed an aggregate amount of ten thousand dollars ($10,000) 4
twenty-five thousand dollars ($25,000) for construction and five thousand dollars ($5,000) ten 5
thousand dollars ($10,000) for all other purchases may be made in accordance with small purchase 6
regulations promulgated by the chief purchasing officer. Procurement requirements shall not be 7
artificially divided so as to constitute a small purchase under this section. 8
SECTION 2. Section 45-55-9 of the General Laws in Chapter 45-55 entitled "Award of 9
Municipal Contracts" is hereby amended to read as follows: 10
45-55-9. Small purchases. 11
Procurements, not to exceed an aggregate amount of ten thousand dollars ($10,000) 12
twenty-five thousand dollars ($25,000) for construction and five thousand dollars ($5,000) ten 13
thousand dollars ($10,000) for all other purchases may be made in accordance with small purchase 14
regulations promulgated by the municipality. These amounts shall be increased or decreased 15
annually hereafter at the same rate as the Boston Regional Consumer Price Index. Procurement 16
requirements shall not be artificially divided so as to constitute a small purchase under this section. 17
A municipality may further reduce the aggregate purchase amount, as provided for in this section 18
by ordinance. 19

This act would increase the maximum state and municipal small purchase limits from ten 1
thousand dollars ($10,000) to twenty-five thousand dollars ($25,000) for construction projects and 2
from five thousand dollars ($5,000) to ten thousand dollars ($10,000) for all other state and 3
municipal purchases. 4
This act would take effect on December 31, 2023. 5
