RELATING TO HOLIDAYS AND DAYS OF SPECIAL OBSERVANCE – WORK ON
HOLIDAYS AND SUNDAYS

It is enacted by the General Assembly as follows:
SECTION 1. Section 25-3-2 of the General Laws in Chapter 25-3 entitled "Work on 1
Holidays and Sundays" is hereby amended to read as follows: 2
25-3-2. Increased pay required for work on Sundays and holidays. 3
(a) Any person, association, or corporation receiving a permit from the division of racing 4
and athletics of the department of business regulation to operate any horse racing, dog racing, or 5
jai alai event under the parimutuel system and any person, association, or corporation doing 6
business under a contractual agreement to provide any services to any horse racing, dog racing, or 7
jai alai event under the parimutuel system shall compensate the necessary persons to conduct the 8
event on Sundays and/or holidays for at least one and one-half (1½) times the normal rate of pay 9
for the work performed, and it shall not be grounds for discharge or other penalty upon an employee 10
for refusing to work at the horse racing, dog racing, or jai alai event upon any of the Sundays and 11
holidays enumerated in this chapter, and nothing contained in this chapter shall prohibit any person 12
from engaging in or being employed in connection with the holding or operation of the licensed 13
event. 14
(b) Notwithstanding any terms of a lawful collective bargaining agreement entered into 15
prior to the effective date of this act, laborers, mechanics, and workers engaged in duties requiring 16
principally physical exertion, who are required to work on Sundays and/or holidays shall be paid 17
by their employers at least one and one-half (1½) times the normal rate of pay for the work 18

SECTION 2. This act shall take effect upon passage. 2

BY THE LEGISLATIVE COUNCIL

RELATING TO HOLIDAYS AND DAYS OF SPECIAL OBSERVANCE – WORK ON
HOLIDAYS AND SUNDAYS

This act would amend the current law so that, aside from any existing contract, all laborers, 1
mechanics, and workers who are required to work on Sundays and/or holidays would be paid by 2
their employers at least one and one-half (1½) times the normal rate of pay. 3
This act would take effect upon passage. 4
