RELATING TO HEALTH AND SAFETY -- RETENTION OF X-RAYS

It is enacted by the General Assembly as follows:
SECTION 1. Section 23-4.9-1 of the General Laws in Chapter 23-4.9 entitled "Retention 1
of X-Rays" is hereby amended to read as follows: 2
23-4.9-1. Retention of x-rays by health care providers. 3
Every physician, surgeon, hospital, health maintenance organization, or any other health 4
care facility or provider that takes a mammography x-ray of any individual within this state shall 5
keep and maintain that mammography x-ray for the life of the individual. Provided, further, 6
however, that any mammography x-ray may be destroyed if the individual has had no contact with 7
the physician, surgeon, hospital, health maintenance organization, or other health care facility or 8
provider for a period exceeding fifteen (15) years period required by the United States Food and 9
Drug Administration. 10
SECTION 2. This act shall take effect upon passage. 11

This act would amend the retention of x-ray statute by eliminating retention for the life of 1
the individual to retention for whatever period is required by the United States Food and Drug 2
Administration. 3
This act would take effect upon passage. 4
