RELATING TO TOWNS AN D CITIES -- LOW AND MODERATE INCOME HOUS ING

It is enacted by the General Assembly as follows:
SECTION 1. Chapter 45-53 of the General Laws entitled "Low and Moderate Income 1
Housing" is hereby amended by adding thereto the following section: 2
45-53-16. Public transportation requirement. 3
(a) Any municipality not provided with public transportation sufficient to extend to urban 4
service boundaries within the municipality shall be permitted to reduce the percentage of low- or 5
moderate-income housing required pursuant to this chapter from ten percent (10%) of the year 6
round housing units reported in the census to six percent (6%) of the year round housing units 7
reported in the census as defined in ยง 45-53-3(4). 8
(b) The decision to issue the percentage reduction provided in this section shall be 9
determined by the approved monitoring agent. 10
SECTION 2. This act shall take effect upon passage. 11
