RELATING TO PUBLIC OFFICERS AND EMPLOYEES -- INSURANCE BENEFITS

It is enacted by the General Assembly as follows: 
SECTION 1. Section 36-12-7 of the General Laws in Chapter 36-12 entitled "Insurance 1 
Benefits" is hereby amended to read as follows: 2 
36-12-7. Eligibility for benefits. 3 
(a) All persons in the service of the state on and after July 1, 1960, whether elected, 4 
appointed or employed, and private employees at nursing homes, developmental disability and 5 
home care providers and employees with developmental disabilities whose salaries are ninety 6 
percent (90%) funded with state or federal monies, who elect to participate in an insurance contract 7 
or contracts shall be eligible to participate therein. The director, however, with the consent of the 8 
insurance company or companies, may by rule or regulation exclude those classes of temporary, 9 
part-time, or intermittent employees for whom insurance contracts shall be deemed to be 10 
impracticable. 11 
(b) The director, with the consent of the insurance company or companies, may authorize 12 
the inclusion in insurance contracts of employees of public authorities, full-time employees of 13 
organizations representing state employees, or other appropriate agencies of the state as may be 14 
designated in the rules or regulations of the director, and may prescribe the rate of contribution 15 
required from such participating authorities, or other agencies. 16 
(c) Private employees listed in subsection (a) of this section who are eligible to opt into the 17 
state healthcare plan shall have the insurance premium deducted from their earnings with the 18 
private employer having the option to contribute to pay all or a portion of the premium payment.  19

BY THE LEGISLATIVE COUNCIL

RELATING TO PUBLIC OFFICERS AND EMPLOYEES -- INSURANCE BENEFITS

This act would allow private employees at nursing homes, developmental disability and 1 
home care providers whose salaries are ninety percent (90%) funded with federal or state monies 2 
to be eligible to opt into the state healthcare plan. The premium payments would be the 3 
responsibility of the employee with the employer having the option to pay all or a portion of the 4 
insurance premium. 5 
This act would take effect upon passage. 6
