Fiscal Impact Summary 
This joint resolution suspends the provision in SC Code Section 58-3-20(C) prohibiting the 126

South Carolina General Assembly from holding an election of members of the Public Service 
Commission (PSC) until a final determination is made by the courts regarding the review of 
congressional districts’ compliance with statutory or constitutional requirements. 
 
PSC indicates that the joint resolution will not have an expenditure impact on the agency as it 
can perform the requirements of the joint resolution in the normal course of business. 
Explanation of Fiscal Impact

State Expenditure 
This joint resolution suspends the provision in SC Code Section 58-3-20(C) prohibiting the 126

South Carolina General Assembly from holding an election of members of the PSC until a final 
determination is made by the courts regarding the review of congressional districts’ compliance 
with statutory or constitutional requirements. Current legislation stipulates that the General 
Assembly must provide for the election of a seven-member commission and elects the members 
based on the congressional districts pursuant to the latest official United States Decennial 
Census. Further, current legislation states that if congressional districts established by the 
General Assembly are under review by a court for compliance with statutory or constitutional 
requirements, an election shall not be held until a final determination is made by the courts. 
 
PSC indicates that currently there is one Commissioner vacancy in District Four. The agency 
further explains that the joint resolution will not have an expenditure impact as the agency 
already has appropriated the funds for all seven Commissioners and that it can perform the 
requirements of the joint resolution in the normal course of business.
