An Act to repeal the requirement for an oath or undertaking by an officer of a third 1
class municipality. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That § 9-14-9 be AMENDED: 4
9-14-9. All undertakings provided for in §§ 9-14-6 to 9-14-7, inclusive, and 9-14-5
6.1 shall be filed, after approval, with the governing body. 6
Section 2. That § 9-14-7 be REPEALED. 7
In third class municipalities the clerk, director of equalization, treasurer, and 8
marshal, within ten days after the first meeting of the month following the election or 9
appointment, shall take and subscribe an oath or affirmation of office in the form required 10
by the Constitution and furnish an undertaking to be approved by the Board of Trustees 11
in such sum as it shall direct. 12
