An Act to waive the driver license renewal period for members of the military and 1 
their families, and employees of the state department. 2 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 
Section 1. That § 32-12-42 be AMENDED: 4 
32-12-42. Each An operator's license, motorcycle operator's license, restricted 5 
minor's permit, or motorcycle restricted minor's permit expires on the licensee's birthday 6 
in the fifth year following the issuance of the license, or on the date of expiration of the 7 
applicant's authorized stay in the United States, as determined by the systematic alien 8 
verification for entitlements system or an alternate method approved by the United States 9 
Department of Homeland Security or, if there is no expiration date, for a period no longer 10 
than one year from the date of issuance, whichever occurs first. 11 
Each Except as provided in section 2 of this Act, an operator's license, motorcycle 12 
operator's license, restricted minor's permit, or motorcycle restricted minor's permit is 13 
renewable one hundred eighty days before its expiration, upon application and payment 14 
of the required fee. 15 
Any A license renewed before its expiration expires five years after the licensee's 16 
ensuing birthday, or on the date of expiration of the applicant's authorized stay in the 17 
United States, as determined by the systematic alien verification for entitlements system 18 
or an alternate method approved by the United States Department of Homeland Security 19 
or, if there is no expiration date, for a period no longer than one year from date of 20 
issuance, whichever occurs first. 21

for renewal, if the licensee applies and makes payment of the required fee within thirty 23 
days following the expiration date. If the licensee applies and makes payment of the 24

expires five years from the licensee's previous birthday, or on the date of expiration of 2 
the applicant's authorized stay in the United States, as determined by the systematic alien 3 
verification for entitlements system or an alternate method approved by the United States 4 
Department of Homeland Security or, if there is no expiration date, for a period no longer 5 
than one year from date of issuance, whichever occurs first. 6 
Section 2. That a NEW SECTION be added to chapter 32-12: 7 
A valid operator's license, motorcycle operator's license, restricted minor's permit, 8 
motorcycle restricted minor's permit, instruction permit, or motorcycle instruction permit 9 
is not subject to the one hundred eighty-day renewable period in § 32-12-42 and may be 10 
renewed at any time regardless of the expiration date, if held by: 11 
(1) An active-duty member of the armed forces of the United States, as defined 12 
in § 33-1-1; 13 
(2) An employee of the United States Department of State serving outside of 14 
the United States; or 15 
(3) A spouse or a dependent of an active-duty member of the armed forces of 16 
the United States. 17
