An Act to make an appropriation for victim services provided by nonprofit 1 organizations. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. There is appropriated $5,000,000 from the general fund, to the Department of 4 Health, for the purpose of providing grants to nonprofit organizations that assist: 5 (1) Children who have been abused or neglected; 6 (2) Victims of domestic violence; or 7 (3) Victims of sexual assault. 8 Section 2. The Department of Health shall annually provide grants in accordance with section 9 1 of this Act on the basis of applications received during the period beginning July first and 10 ending August thirty-first, of each year. 11 Recipients may use the grants for: 12 (1) The provision of emergency and transitional services, including food, lodging, and 13 transportation; 14 (2) The provision of counseling services; 15 (3) The support of a crisis line; 16 (4) Case management and facility staffing needs; 17 (5) Training, certification, or employment of a sexual assault nurse examiner; and 18 (6) Services provided through a child advocacy center. 19 The department may award grants for any request not receiving full funding from 20 any other agency of this state. The department shall consider the financial situation of the 21 applicant and prioritize awarding grants to an applicant who demonstrates a financial need 22 or inability to raise sufficient moneys for the services or uses in subdivisions (1) to (5), 23 inclusive, of this section. 24 25.857.12 2 1221 Underscores indicate new language. Grants may not be used to establish a new program or organization, or for the 1 provision of legal services. 2 The Department of Health may expend moneys from the appropriation provided in 3 section 1 of this Act for the administrative costs necessary to provide the grants. 4 Section 3. The secretary of the Department of Health shall approve vouchers and the state 5 auditor shall draw warrants to pay expenditures authorized by this Act. 6 Section 4. Any amounts appropriated in this Act not lawfully expended or obligated shall 7 revert in accordance with the procedures prescribed in chapter 4-8. 8 Section 5. This Act is effective beginning June 30, 2025. 9
