A CONCURRENT RESOLUTION, Supporting the Electoral College, denouncing the 1 National Popular Vote Interstate Compact, and inviting interested states to 2 form the Electoral College Interstate Compact. 3 WHEREAS, the current electoral college system respects states as the essential units in 4 our compound republic, protecting their power and voice in presidential elections; and 5 WHEREAS, the current electoral college system respects the separation and balance of 6 power and authority between the states and the federal government; and 7 WHEREAS, the current electoral college system creates a needed balance between rural 8 and urban interests and ensures that the winning candidate has support from multiple regions 9 of the country; and 10 WHEREAS, the current electoral college system ensures that each state's electoral votes 11 are awarded based on how the state's citizens vote; and 12 WHEREAS, the current electoral college system best preserves our constitutional 13 separation of powers and prevents the fracture of America's political structure; and 14 WHEREAS, the founding fathers rejected a national popular vote for president and instead 15 created the Electoral College; and 16 WHEREAS, the National Popular Vote Interstate Compact diminishes the importance of 17 individual states in presidential elections, creates the potential for nationwide recounts, and 18 opens the door to greater federal control; and 19 WHEREAS, under the National Popular Vote Interstate Compact, a state's electoral vote 20 could be awarded to a candidate opposed by the majority of our state's citizens; and 21 25.862.11 2 HCR6013 Underscores indicate new language. WHEREAS, the constitutionality of the National Popular Vote Interstate Compact is 1 doubtful because it appears to violate the text of the Compact Clause of the United States 2 Constitution and the intent of the electoral college clauses; 3 NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the One 4 Hundredth Legislature of the State of South Dakota, the Senate concurring therein, that the 5 Legislature supports the Electoral College and believes the National Popular Vote Interstate 6 Compact may be unconstitutional; and 7 BE IT FURTHER RESOLVED, that this Legislature invites all other interested states to form 8 an Electoral College Interstate Compact to prohibit electors from participating states from 9 casting the elector's vote in accordance with the national popular vote count and require the 10 participating states to legally challenge the constitutionality of the National Popular Vote 11 Interstate Compact; and 12 BE IT FURTHER RESOLVED, that this Legislature proposes forming the Electoral College 13 Interstate Compact when four other states declare their intent to form the Electoral College 14 Interstate Compact, at which time the interested states shall take appropriate steps to 15 organize and form the compact; and 16 BE IT FURTHER RESOLVED, that the secretary of state forward copies of this resolution to 17 the secretaries of state and majority and minority leaders in each legislative chamber in the 18 states of Alabama, Alaska, Arkansas, Arizona, Florida, Georgia, Iowa, Idaho, Indiana, Kansas, 19 Kentucky, Louisiana, Michigan, Mississippi, Missouri, Montana, Nebraska, Nevada, New 20 Hampshire, North Carolina, Ohio, Oklahoma, Pennsylvania, South Carolina, Tennessee, 21 Texas, Utah, West Virginia, Wisconsin, and Wyoming. 22
