An Act to require certain firefighting equipment purchased by a fire department 1
contain particular labeling. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That a NEW SECTION be added to chapter 34-31: 4
A fire department in this state may only purchase firefighting personal protective 5
equipment that has a permanently affixed label indicating whether the equipment contains 6
a perfluoroalkyl or polyfluoroalkyl substance. 7
For the purposes of this section, "firefighting personal protective equipment" 8
means coats, coveralls, footwear, gloves, helmets, hoods, trousers, and any other clothing 9
designed or intended to be worn by firefighting personnel during fire and rescue activities. 10
Section 2. This Act is effective beginning July 1, 2026. 11
