Overstrikes indicate deleted language. An Act to increase civil penalties for commercial driver violations. 1 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 2 Section 1. That § 32-12A-5.1 be AMENDED: 3 32-12A-5.1. The state's attorney for the county in which a violation of subdivision 4 32-12A-5(4) occurs shall commence a civil in rem proceeding of not more than nineteen 5 thousand three hundred eighty -nine twenty thousand seventeen dollars against the 6 employer. 7 Section 2. That § 32-12A-56 be AMENDED: 8 32-12A-56. In addition to disqualification, a driver who is convicted of violating 9 an out-of-service order pursuant to § 32-12A-8.1 is subject to a civil penalty of not less 10 than three thousand seven hundred forty three thousand eight hundred and sixty-one 11 dollars for a first conviction and not less than seven thousand four hundred eighty-one 12 seven thousand seven hundred and twenty -three dollars for a second or subsequent 13 conviction. 14 Section 3. That § 32-12A-57 be AMENDED: 15 32-12A-57. The state's attorney for the county in which the violation of 16 subdivision 32-12A-5(3) occurs shall commence a civil in rem proceeding of not less than 17 six thousand seven hundred fifty-five six thousand nine hundred and seventy-four dollars 18 nor and not more than thirty-seven thousand four hundred thirty eight thousand six 19 hundred and twelve dollars against the employer. 20
