An Act to repeal reporting and testifying requirements to the committees on health 1
and human services regarding nursing facilities and long -term healthcare 2

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 4
Section 1. That § 34-12-35.11 be REPEALED. 5
The Department of Health and the Department of Human Services shall, before the 6
fourth Tuesday in January of each year, submit a written report to and testify before the 7
Senate and House standing committees on health and human services concerning the 8
consideration of additional nursing facility beds or additional new nursing facilities and 9
long-term healthcare needs pursuant to § 34-12-35.7. 10
