An Act to make an appropriation to the Department of Revenue for distribution to 1 county rural access infrastructure funds and to declare an emergency. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. That § 31-34-2 be AMENDED: 4 31-34-2. Before August 1, 2021, the Department of Revenue shall distribute the 5 sum of three million dollars on a pro rata basis to each county for the purpose of planning 6 and completing an inventory of small structures as prescribed by the Department of 7 Transportation. Before August 1, 2022 For any moneys appropriated for county rural 8 access infrastructure, the Department of Revenue shall distribute a portion of the sum of 9 three million dollars appropriation to each county based on the allocation calculated in 10 accordance with this section for the purposes described in § 31-34-3. Each county's 11 allocated percentage is calculated by using the total number of small structures on 12 township roads and county secondary roads located in a county divided by the sum of all 13 small structures on township roads and county secondary roads in the state as reported 14 to the Department of Transportation, multiplied by one hundred. Each county that receives 15 moneys from this rural access infrastructure program shall use the moneys in accordance 16 with the provisions of this chapter. 17 Section 2. There is appropriated $25,000,000 from the general fund, to the Department of 18 Revenue, to distribute in three equal amounts in fiscal years 2026, 2027, and 2028, to county 19 rural access infrastructure funds pursuant to § 31-34-2. 20 Section 3. The secretary of the Department of Revenue shall approve vouchers and the state 21 auditor shall draw warrants to pay expenditures authorized by this Act. 22 Section 4. Any amounts appropriated in this Act not lawfully expended or obligated by June 23 30, 2028, shall revert in accordance with the procedures prescribed in chapter 4-8. 24 25.651.16 2 95 Underscores indicate new language. Whereas, this Act is necessary for the support of the state government and its 1 existing public institutions, an emergency is hereby declared to exist, and this Act shall be in 2 full force and effect from and after its passage and approval. 3
