HB 56 – SB 39 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 6, 2025 Fiscal Analyst: Justin Billingsley | Email: justin.billingsley@capitol.tn.gov | Phone: 615-741-2564 HB 56 – SB 39 SUMMARY OF BILL: Authorizes a county legislative body (CLB) to recall a person appointed to a position by such body upon a two-thirds vote, regardless of any charter, resolution, or law to the contrary. Specifies that this authorization does not apply to a person appointed by a CLB to fill a vacancy in the General Assembly. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • A vote to recall a person appointed by the CLB will take place at a regularly scheduled meeting of the CLB; any increase in local expenditures is estimated to be not significant. • A successful recall vote will lead to a vacant position which must be filled by the CLB. • It is reasonably assumed that any CLB choosing to recall a person appointed to a position by the body has a plan in place to fill such vacancy, and that such appointment will occur during a regularly-scheduled meeting of the respective CLB. • Any impact to local operations is considered not significant. • Pursuant to Tenn. Code Ann. § 5-5-111(a)(2), the presiding officer of the CLB must provide public notice of a vacancy at least seven days prior to the meeting of the body at which the office is to be filled. • Notice of the vacancy will be included in the public notice required for all regular meetings of the CLB; any increase in local expenditures is estimated to be not significant.
