HB 134 - SB 476 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly March 11, 2025 Fiscal Analyst: Alan Hampton | Email: alan.hampton@capitol.tn.gov | Phone: 615-741-2564 HB 134 - SB 476 SUMMARY OF BILL: Beginning August 1, 2027, requires each local education agency (LEA) and public charter school to prohibit food or beverage items that contain the synthetic food dye known as Red 40, to be sold, offered for sale, or provided to students on school property unless the food or beverage item is sold to the student as part of a school fundraising event. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • The Department of Education (DOE) will implement all necessary changes and train, monitor, document, and assist local school food authorities utilizing existing resources, without a significant increase in state expenditures. • It is reasonably assumed, that by utilizing the assistance and guidance of the DOE’s school nutrition team, LEAs and public charter schools will be able to amend their policies within existing resources and will be able to procure food items through contracts with existing or futures vendors such that no received products will contain Red 40. • Any increase in local expenditures is estimated to be not significant.
