SB 213 – HB 303 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly January 24, 2025 Fiscal Analyst: Laura Moore | Email: laura.moore@capitol.tn.gov | Phone: 615-741-2564 SB 213 – HB 303 SUMMARY OF BILL: Authorizes the sale or purchase of previously titled antique or unique motor vehicles to be made without a motor vehicle dealer license at an auction held in conjunction with the Chattanooga Motorcar Festival held in Hamilton County. Effective October 17, 2025, and repealed October 22, 2025. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • The Chattanooga Motorcar Festival is held in Chattanooga, TN each year. All proceeds from the festival go to the Neuroscience Innovation Foundation in support of Alzheimer’s and neuroscience research. • The Tennessee Motor Vehicle Commission’s (MVC) rules and regulations require anyone who sells more than five motor vehicles in one year to obtain a license as a motor vehicle dealer. • According to the MVC, during prior instances of the festival, sellers were not required to obtain licensure as a motor vehicle dealer because MVC grants an exception to the organizers of the festival and auction. • It is assumed that participants in the festival and auction would not be required to obtain a license in the absence of this legislation; therefore, any fiscal impact to the MVC will not be significant. • Pursuant to Tenn. Code Ann. § 4-29-121, all regulatory boards are required to be self- sufficient over any two-year period. The MVC experienced a deficit of $256,605 in FY22- 23, a deficit of $517,450 in FY23-24, and had a cumulative reserve balance of $1,156,227 on June 30, 2024. IMPACT TO COMMERCE: NOT SIGNIFICANT Assumption: • Any impact to commerce or jobs in the state is estimated to be not significant.
