SB 236 - HB 305 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly March 7, 2025 Fiscal Analyst: Arielle Woodmore | Email: arielle.woodmore@capitol.tn.gov | Phone: 615-741-2564 SB 236 - HB 305 SUMMARY OF BILL: Requires a law enforcement agency (LEA) to send automatic notification to a qualified non-profit organization of calls received for emergency assistance services at a rental home or apartment complex, if the qualified nonprofit organization has registered the address of the rental home or apartment complex with the law enforcement agency for the purpose of distributing the calls for service to rental property owners and managers. FISCAL IMPACT: LOCAL GOVERNMENT EXPENDITURES Mandatory FY25-26 $3,110,000 FY26-27 & Subsequent Years $1,555,000 Article II, Section 24 of the Tennessee Constitution provides that: no law of general application shall impose increased expenditure requirements on cities or counties unless the General Assembly shall provide that the state share in the cost. Assumptions: • The proposed legislation will require law enforcement agencies and dispatch centers to acquire or build new software to meet the notification requirements of the proposed legislation. • Each law enforcement agency will be required to procure or develop its own software as well as manage and implement the notification system. • The exact cost of implementation, subscription, and maintenance of any such software is unknown and expected to vary between agencies. However, based on information provided by the Tennessee Sheriffs’ Association, such software is estimated to be $10,000 to implement and $5,000 in recurring expenditures for subscription and maintenance fees for each law enforcement agency. • Based on U.S. Department of Justice data, there are 311 law enforcement agencies in Tennessee. • The one-time increase in local expenditures for FY25-26 associated with law enforcement agencies purchasing the required software is estimated to be $3,110,000 (311 LEAs x $10,000). • The total recurring increase in local expenditures associated with law enforcement agencies maintaining the required software is estimated to be $1,555,000 (311 LEAs x $5,000) in FY26-27 and subsequent years.
