SUMMARY OF BILL: Prohibits a person from offering for sale, selling, or offering a free
sample of a counterfeit lighter or unsafe lighter. Establishes a violation of such as an unfair and
deceptive act or practice under the Consumer Protection Act of 1977.
FISCAL IMPACT:
NOT SIGNIFICANT
Assumptions:
• Per the proposed legislation, “counterfeit lighter” means a lighter that infringes on an
intellectual property right of a citizen of the United States or a person who is protected by
federal or state intellectual property law.
• Per the proposed legislation, “unsafe lighter” means any of the following:
o A disposable or refillable cigarette, cigar, or pipe lighter that does not comply with
American Society for Testing and Materials (ASTM) standard F400-20; or
o A utility, grill, or fireplace lighter, or a lighting rod or gas match, that does not
comply with ASTM standard F2201-20.
• Any increase in the number of complaints handled by the Attorney General is estimated to
be not significant and can be handled by existing staff during normal work hours.
• Committing an unfair or deceptive act or practice under the Consumer Protection Act of 1977 is
a Class B misdemeanor offense.
• There will not be a sufficient number of violations for state or local government to
experience any significant increase in expenditures related to prosecutions or incarceration.
• Any additional workload on the courts can be accommodated within existing resources.
IMPACT TO COMMERCE:
NOT SIGNIFICANT
Assumption:
• Any impact to commerce or jobs in Tennessee is estimated to be not significant.
