HB 387 - SB 474 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly March 4, 2025 Fiscal Analyst: Chris Higgins | Email: chris.higgins@capitol.tn.gov | Phone: 615-741-2564 HB 387 - SB 474 SUMMARY OF BILL: Prohibits a healthcare provider, other than a licensed psychiatrist or psychologist, from inquiring as to a patient's ownership, possession of, or access to firearm ammunition or firearm accessories. Prohibits a healthcare provider from discriminating against a patient based upon the patient's exercise of the constitutional right to own and possess a firearm, firearm ammunition, or firearm accessories. Establishes that a healthcare provider who violates the legislation is subject to a disciplinary action by the healthcare provider's licensing authority and a fine of $1,000 per violation. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Prohibiting certain healthcare providers from inquiring as to a patient's relationship to firearm ammunition or firearm accessories will not have a significant impact on the operations of the health-related boards of the Department of Health. • The appropriate health-related boards can promulgate rules and take disciplinary action utilizing existing personnel and resources, without an increase in expenditures. • Any increase in state revenue from fines as a result of the proposed legislation is estimated to be not significant.
