SB 441 - HB 478 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 26, 2025 Fiscal Analyst: Natalie Dusek | Email: natalie.dusek@capitol.tn.gov | Phone: 615-741-2564 SB 441 - HB 478 SUMMARY OF BILL: Creates an exception to the offense of possessing or carrying a firearm into an area where firearms are not permitted for a person who, upon the request of an individual authorized to control access to the property, immediately leaves the property or stores the firearm in a personal vehicle in accordance with state law. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 39-17-1359(c), possession of a weapon on posted property is a Class B misdemeanor offense punishable by a fine only of $500. • The proposed legislation creates an exception to this offense if, upon request by an individual authorized to control access to the property, the person: o Immediately leaves the property; or o Properly stores the firearm in a personal vehicle in accordance with the regulations specified in Tenn. Code Ann. § 39-17-1313. • Based on information provided by the Administrative Office of the Courts, in the last five years, there has only been one conviction in this state for possession of a weapon on posted property. • Therefore, the proposed legislation will not result in a significant decrease in local expenditures related to Class B misdemeanor convictions for the offense.
