SB 513 - HB 628 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 18, 2025 Fiscal Analyst: Elizabeth Bransford | Email: elizabeth.bransford@capitol.tn.gov | Phone: 615-741-2564 SB 513 - HB 628 SUMMARY OF BILL: Extends, from June 30, 2025 to June 30, 2028, the authorization for retired emergency medical services employees to return to work as an emergency medical services employee without loss or suspension of retirement benefits. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 8-36-811: o Retired members may temporarily return to work as an emergency services employee for one year and retain the return-to-work compensation and 70 percent of the member’s retirement allowance. To qualify, the retiree must: ▪ Possess a current and valid license to provide emergency medical services; ▪ Be reemployed upon the expiration of 60 calendar days after the member’s effective date of retirement; and ▪ Not be drawing retirement disability benefits; o The retired member’s reemployment is limited to one year, but the member may be reemployed to additional one-year terms; o The retired member’s new employer must pay the greater of the employer’s contributions or five percent of the retired member’s pay rate to the Tennessee Consolidated Retirement System (TCRS). o This return-to-work provision will repeal June 30, 2025. • The proposed legislation extends the return-to-work provision by three years, to repeal on June 30, 2028. • According to the TCRS, there were three retired members utilizing this return-to-work provision in FY22-23 and two members in FY23-24. • The proposed legislation is not anticipated to significantly impact administrative costs for TCRS. • There will be no change in the overall lump sum pension liability. • Total employer contributions by local governments to retirement funds will not significantly change compared to what would have otherwise been paid for an alternative employee filling the position. • Any impact to local government is estimated to be not significant.
