SB 619 - HB 657 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 12, 2025 Fiscal Analyst: Chris Higgins | Email: chris.higgins@capitol.tn.gov | Phone: 615-741-2564 SB 619 - HB 657 SUMMARY OF BILL: Establishes that a healthcare provider who has had an adverse action taken against the provider's license or registration by a relevant licensing board requiring completion of a peer assistance or treatment program contract has the right to petition the board to remove information from public dissemination regarding the adverse action and consent order after 10 years from the start of the probation date indicated in the consent order. Requires the relevant board to review and make a determination on a removal request, and, if approved, to remove the requested information from any place the information is made public. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 63-32-105(a)(2), the Department of Health (DOH) is required to create individual profiles on healthcare licensees of each board for dissemination to the public, including a description of any final board disciplinary actions taken against a provider within the most recent 10 years. • The Division of Health-Related Boards (HRBs) can promulgate rules to allow for the removal of information regarding a peer assistance or treatment program contract utilizing existing personnel and resources. • Any fiscal impact to DOH or HRBs from hearing petitions or removing requested information is estimated to be not significant.
