HB 868 - SB 1040 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly March 27, 2025 Fiscal Analyst: Christine Drescher | Email: christine.drescher@capitol.tn.gov | Phone: 615-741-2564 HB 868 - SB 1040 SUMMARY OF BILL: Prohibits a political campaign committee (PCC) that is headquartered or domiciled in another state, country, or territory, to either directly or through another PCC make a contribution to a Republican candidate in a primary election. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • The proposed legislation would be an addition to the Campaign Financial Disclosure Act of 1980, which, according to Tenn. Code Ann. § 2-10-101(b), does not apply to any candidate for public office for which the service is part time and for which the compensation is less than $1,000 per month. • Pursuant to Tenn. Code Ann. § 2-10-102(4), “contribution” means any advance, conveyance, deposit, distribution, transfer of funds, loan, loan guaranty, personal funds of a candidate, payment, digital currency, gift or subscription of money or like thing of value, and any contract, agreement, promise or other obligation, whether or not legally enforceable, made for the purpose of influencing a measure or nomination for election or the election of any person for public office or for the purpose of defraying any expenses of an officeholder incurred in connection with the performance of the officeholder’s duties, responsibilities, or constituent services. • Any decrease in contributions to candidates as a result of the proposed legislation will not have any fiscal or operational impact on state or local governments.
