Repeals the prohibition on hazardous waste management facilities within two miles of Class II scenic rivers and eliminates restrictions on hazardous waste disposal facilities near these waterways. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • The proposed legislation does not introduce new programs, expand government operations, or require additional state or local funding. It removes existing restrictions on landfill and hazardous waste facility locations near Class II scenic rivers without adding new compliance requirements. • No financial obligations are shifted to state or local governments, as the legislation does not mandate new infrastructure, staffing, or oversight responsibilities. • Based on information provided by the Department of Environment and Conservation (TDEC), there have been no recent requests for new landfills. The proposed legislation is therefore expected to primarily affect landfill expansions, which TDEC anticipates will be minimal. As a result, the proposed legislation is not expected to generate a significant increase in permit revenue.
